License for use of fonts in server applications

This End User Licence Agreement (‘EULA’) is a legal agreement between you (either as an individual or on behalf of an entity) and Superior Type s.r.o., a Sole proprietor duly organised and existing under the laws of the Czech Republic, having its registered office at Jankovcova 18a, 170 00 Praha 7, Czech Republic, TAX ID 17163692, VAT ID: CZ17163692 (referred to as ‘Superior Type s.r.o.’).

You must agree to all of the terms of this EULA to use this Font Software (‘fonts’)

You are not granted the copyright to the design or the ownership of the fonts, but the rights to use the fonts

The Agreement

By downloading, installing, using, or copying the Font Software (‘fonts’), you accept and agree to be bound by the terms of this EULA. If you do not agree to all of the terms of this EULA, you may not download, install, use or copy the fonts.

The License

This license grants you to:

Use the fonts as a part of a cloud-based service for automated creation of documents via internet browsers by unlimited number of end users provided the yearly gross revenue of you or your projects does not exceed € 50,000,000

Use the fonts without territorial restrictions provided the number of servers does not exceed the number of servers detailed on the invoice you received with the purchase of the font and all servers belong to the same company or organisation

Subset the fonts only for the purpose of optimising the loading time of the service

Make a backup copy of fonts only for your own purposes

The Restrictions

You are not permitted to:

Embed the fonts on any website or in digital ad using @font-face

Embed the fonts into any hardware products or devices (ie. the displays or interface)

Use the fonts in products that reproduce letter shapes (ie. house numbers, stamps)

Upload the fonts to any public server or GIT repository available to users outside your organisation

Use the fonts in any broadcast branding including a tv channel or internet streaming service

Embed the fonts into any mobile or computer application or game

Sell, resell, rent, lease or exchange the fonts for anything of value

Copy the fonts or allow third party to copy the fonts

Transfer the license to the third party

Intellectual Property and Ownership

You are not granted the copyright to the design or the ownership of the fonts, but the rights to use the fonts. The fonts and other intellectual property rights therein are the exclusive property of Superior Type s.r.o.

Returning and exchanging fonts

The fonts may be returned or exchanged only if defective and will be replaced only when accompanied by a valid sales receipt within 30 days since purchase.

Limited Warranty

The font software is provided on an "as is" basis, and no warranty, either express or implied, is given. Your use of the font software is at your sole risk. Superior Type s.r.o. makes no warranties, express or implied, as to merchantability, fitness for a particular purpose, or otherwise. The font software was not manufactured for use in manufacturing control devices or navigation devices or in circumstances that could result in environmental damage or personal injury.

No liability for damages

You expressly understand and agree that Superior Type s.r.o. shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Superior Type s.r.o. is aware of the possibility of such damages) related to the use of this font software. Under no circumstances shall liability exceed the replacement cost of the font software.

Termination

This Licence Agreement is effective as of the Date of full payment for the purchased licence type. Without prejudice to any other rights, Superior Type s.r.o. may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the fonts.

Governing Law

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of the Czech Republic.

Miscellaneous

Superior Type s.r.o. reserves the right to modify or update this license at any time without notice
